Any Aggie who complains about this should think of "The 12th Man" first.
I believe there ought to be a constitutional amendment outlawing AstroTurf and the designated hitter. I believe in the sweet spot, soft-core pornography, opening your presents Christmas morning rather than Christmas Eve and I believe in long, slow, deep, torture of Bud Selig.

Not that I have a dog in this hunt, but the situations are not analogous.  Fyi, the Seahawks settled with A&M by agreeing to acknowledge the A&M trademark, they can still use the phrase,  The Link

Who said anything about complaining?  Personally, while I enjoy the long standing rivalry in a friendly manner (especially now that it seems to be a little more relevant - read "it's nice to win one every now and then") but the constant references, by A&M, to UT, or it's logo, strikes me as a little tiresome.  On the other hand, when UT won the National Championship, I thought the longhorn with the bandages was a humorous take on Aggies supporting UT as a fellow Texas, Big-12 representative.  But that's just me.

They are.  They recognize the need to protect logos and identities.
The rules of distinction were thrown out with the baseball cap.  It does not lend itself to protocol.  It is found today on youth in homes, classrooms, even in fine restaurants.  Regardless of its other consequences, this is a breach against civility.  A civilized man should avoid this mania.

as has already been pointed out the two situations are not analogous.  

in one instance you have a corporate entity directly using the exact same phrase, which had a prior trademark on it.

in one instance you have a member of rivalry modifying a logo, changing its appearance enough that it obviously doesn't represent any official University of Texas merchandise.

the intentions were never to copy, or imply that aggies, or the merchandise being purchased, were longhorns or licensed paraphernalia.  

but indeed, they are simply defending their trademark.  which means, from what i understand, which could be way off, they just need to make a show of defending it for it to not lapse.  which is why TAMU itself siding with UT, as was also pointed out in the article, its a matter of standard operating procedures for universities to back one another in trademark disputes.  

and indeed, as has been pointed out that it will be up to the courts to decide if it was enough of a parody.

I keep wondering what last year's team would have been like with Augustin at point.  That team had no guards who could get into the paint on their own, or who knew how to make an entry pass to somebody who had position.  Augustin is excellent at both.  He reminds me of UConn's point guard last year (Williams?).

Alternatively, I wonder what this year's team would be like with Tucker available to clean up the boards.  That (along with some defensive weakness, although I see signs of improvement there) is their biggest problem right now.

The lopped off horns are certainly a parody inspired by the original. However, if someone is using the altered logo repeatedly in various designs, all strictly for commercial purposes, then they've crossed into another area. UT would have a hard time claiming that the altered logo is hurting sales of merchandise containing the original logo. There could be a court odered cease and desist issued and, even though UT's interest isn't really about the dude making money, UT  might for insist on royalties for every item purchased up to the present. It's about not allowing just anyone to use your logo without consent. UT's interest is protecting it's logo and really must challenge any inappropriate use and any percieved infringment.

Aggies have been buying the original stickers and clipping the horns off for many years, at least since I went to school there in the early 80s. That's obviously ok from a legal standpoint, since they were buying the stickers from the licensee.

There are many items for sale now, with the clipped horns. I don't recall when I started seeing them for sale though; has to be 10+ years.

It was pretty heavily merchandised when I was there in the 90's so it's more than 10 yrs.  Of course, the student created shirts were much more liberal with copyright material.

UT is not going after A&M, they are going after a private individual who is in no way affiliated with A&M.  As has been mentioned already, A&M is squarely supporting UT in this deal.

I understand why UT is doing this- I think that they will probably win, and at the same time I think that it is wrong.

This seems, imho, like something that should be treated as a parody- but I'm guessing the court sides with UT.  Like Jimr said though- that's what the courts are for.
