Drunk Driver Kills 2 at SXSW

This is awful.  The driver was fleeing a routine traffic stop, fled the wrong way on a one-way street and then drove through barriers closing off a street and into a moped - killing both aboard - pedestrians and other cars.  23 injured, 5 critical.  He then tried to flee and got stun-gunned and arrested.

WTF?

Nope, misdemeanor.  Fleeing arrest in a vehicle is a felony; killing someone while doing so is capital murder.

Is this correct?  I know there are numerous circumstances that make it a capital offense, but I didn't think fleeing arrest is one of them.  Killing more than one person does, though.

The Statesman is reporting the driver as Rashad Charjuan Owens, 22, of Killeen. And to clarify, he hit both a bicyclist and 2 people on a moped--the guy on the bike died and one of two people on the moped were killed.

Take the cloud you all feel and multiply that exponentially and you'll get some idea of what it's like inside. It's a horror that will have repercussions we can't yet imagine. Everyone standing is struggling with it one way or another.

I've seen nothing on that yet, but his background isn't looking too rosey.  Previous DWI in Alaska, plus other petty crimes as he bounced around between Alaska, Texas, Florida and the Carolinas.  He has six kids...at age 22.  I'm guessing that "smart" is not going to be a word much used to describe this guy.
