Pole Tax...NY style

NY Supreme Court rules that nude dancing is not art, unlike say ballet, but rather "entertainment", and is not exempt from sales tax.

The court split 4-3, with the dissenting judges saying there's no distinction in state law between "highbrow dance and lowbrow dance," so the case raises "significant constitutional problems."

Discuss.

The rules of distinction were thrown out with the baseball cap.  It does not lend itself to protocol.  It is found today on youth in homes, classrooms, even in fine restaurants.  Regardless of its other consequences, this is a breach against civility.  A civilized man should avoid this mania.

At first blush, I'd have to agree with the dissent based on the way the statute is written.  If it exempts dance performances in general, it's hard for a taxing agency or a court to say that one form of dancing qualifies but another form of dance doesn't.

I don't know.  If she's ugly the dancing probably has higher artistic merit.  It's, like, postmodern.

They're just "small business owners" who want to give back to their communties.  Damn that 1%!
