Tejada charged with lying to Congress about steroids
« on: February 10, 2009, 12:32:43 pm »
http://www.washingtonpost.com/wp-dyn/content/article/2009/02/10/AR2009021001356.html?hpid=topnews

Prosecutors did not charge Tejada with lying about allegations concerning his own steroids use.

Instead, they accuse Tejada of giving false statements to Congressional staffers about his conversations with another player about steroids and human growth hormone.

I'm pretty sure Tejada was an Oakland Athletic at the time of the alleged purchase.

It was the time of the alleged "conversation", not purchase.  Tejada is being charged for misrepresenting a conversation, not an act.  That's a bit of a stetch, to me.  How do you prove beyond a reasonable doubt that a conversation took place?  And if so, why do you care that much?

Tejada to plead guilty

All-Star shortstop Miguel Tejada has been charged with lying to Congress about steroids. Tejada is scheduled to appear in court Wednesday where he is expected to plead guilty.

The charges against Tejada, who currently plays for the Houston Astros, were outlined in documents filed in Washington federal court on Tuesday.

The documents indicate that a plea agreement has been reached with Tejada.

That's certainly the easiest way out at this point.  His attorney should have made him plead the fifth when he was being questioned.

So, anyone seen a report as to what the plea agreement will net the Astros projected starting SS?  For chrissakes people, where are your priorities?  Congress I can do without.  But the Astros need a starting friggin' shortstop if this season's going to be worth a DAMN!

I've generally been impressed by the MLB Network so far, but last night they were talking about how serious all this is for Tejada, specifically noting that it's a felony. Today the Chron says misdemeanor (http://www.chron.com/disp/story.mpl/sports/bb/6257316.html). Who to believe?

ETA: Never mind; just saw this discussed in the other forum.

Even if 14 million became available, there isn't anything exciting left in free agency with regards to short, third (maybe Crede if healthy), or starting pitcher.
Have to turn to a trade, but then you are coming in from a have to get something done perspective so you're looking at taking it up the arse there as well.

From ESPN's summary of the plea hearing:

Quote
Tejada, who was born in the Dominican Republic, listened through headphones to a simultaneous Spanish translation as federal magistrate Judge Alan Kay warned him of the rights he was waiving with a guilty plea.

"Your plea of guilty may have some impact on your immigration status here in the United States," Kay said.

Tejada responded that he understood and had discussed his fate with his attorney.

Damning by faint praise the way Rusty and Roger have handled their case.  But Tejada's attorneys should have told him to STFU back in 2005.

I have no legal background but I'm making a logical connection with the Feds getting their hands on the test results and Tejada's plea deal.  Much of this is based on the quote below:

Quote
"This is a stand-alone case," Tuohey said. "It has no relationship to any other case pending. There are no allegations of use of performance-enhancing drugs by Mr. Tejada. The only allegations, and the only relative facts that they found, dealt with Mr. Tejada's failure to state that a player told him he used steroids."

My assumption being Tejada would have faced more than a charge of lying about his knowledge of other's PED use if his name had shown up on the list of 104.

Damning by faint praise the way Rusty and Roger have handled their case.  But Tejada's attorneys should have told him to STFU back in 2005.

A friend of mine told me that Clemens sat a couple of rows over from him at the UT basketball game Tuesday night.  Had a hat pulled down low and unshaven and said it appeared he was sort of using his kid and a couple of other teens with them as "shields."  Friend also said in prior years there would be a line of people by his seat throughout the game for autographs.  Not a one this time.

And, majority of Clemens' defamation suit tossed out

Is Hardin as incompetent as all of these events would seem to suggest? Or has he merely been following the strategy his client insists upon?

I remember they threw together this filing in Texas pretty quick.  It's probably pretty sloppy.  They were hoping to keep the case out of New York.  Original petition

Rusty is hardly incompetent.  He just has a crappy case.

And if anybody can find a more detailed/informed article on it, I'd appreciate it.  The ESPN article provides no comprehensible explanation of what happened.

Noe, what is Clemens' reason for wanting to keep the case out of New York?  Is it just that he thought he'd get a better hearing in Houston?

Also, the only piece of the Houston lawsuit that remains intact relates to a conversation between two people who have both previously testified under oath that what they discussed is true.  Beautiful.

Here's an article from the NY Daily News, that has some more detail in it and a cool syringe logo.

I dunno if it's related, but a lot of overly broad, bogus patent litigation is filed in Texas as well.  I guess our juries like awarding cash and prizes to fraudsters.

Because his backwoods Hyper Chicken Lawyer routine would go over better with a Houston jury than one in Noo Yawk Sitty.
