ETA and I have been personal friends for many years, despite that we live in different states. We speak periodically on the phone, and he actually hosted me in Houston for an OWA OD several years back. I buy tickets with the group every year, and it seems that my schedule falls apart at the end, and Mr. & Mrs. ETA get my tickets with my compliments. He doesn't come around as often as he used to, and I'm a little sad about that.

I am around, just little to say. There are good people here.

Now, I am in the Houston area, but live just off the EasTex freeway, so I figured it would still count.

And yes, April 6th was my last post before today.

One thing I do not do is criticize or make fun of someone’s religion. My disgust with the Mets is having Tebow in major league camp and taking a spot from someone more deserving. My criticism is of his lack of talent at this level, and of the Mets blatantly using his celebrity for publicity, not Tebow’s faith.

Great point, Jim. I doubt Tim i upset by people remembering him for his faith, and I respect him highly for taking a stand for his beliefs. Humor is not always malicious, but you posted a great reminder to consider our intent.

The personnel management is above my understanding, so I should not comment on that.

  One feature most weather sites have that is missing in Baseball forums is a they break out users into groups so that you can more quickly discern the value of the post.  Degreed meteorologists are clearly defined (typically by a red tag of some sort).  So are professional forecasters and people that work in related fields like broadcast weather.  The forums are typically heavily moderated by capable and fair mods so people that make a bunch of wack comments are run.  I won't go so far as to say they are academic forums but they bend in that direction.

The way I saw it, he knew his pitch was off. It wasn't intentional. The ump didn't need to step in there. The situation would have been terrible to hit a batter. It made no sense in any way. On the other hand, it didn't hurt anything. The teams were trying to win, not beat each other up.

I'm a fan of cooking a few strips of bacon about half way, and then putting them in the waffle iron on top of the batter so that that  after it cooks you end up with bacon embedded in the waffle.  Plus the waffle then soaks up the remaining grease so you don't really need syrup at that point.  Top with a couple of fried eggs.

I think I just had an e-heart attack.

My father once did calligraphy. He accidentally stabbed his finger with the pen. Everyone in my family now has the same mark on our fingers, thought you wouldn't know it if I didn't point it out. It means quite a bit to me to be tied to my family that way.

It's not necessarily a lack of maintenance.  Like most pieces of infrastructure, it was designed for a specific purpose and a finite lifespan. Going beyond its engineering in both usage and duration will be a problem at some point, regardless of how well it's maintained. "Functionally obsolete" and "meticulously maintained" are not exclusive. And I don't know how well this bridge was maintained. But I do know it was old and has been used harder than was intended. It's pretty common these days.

In an extremely sad way, this reminded me of the space shuttle program.

One thing that may play out is that they were storing 1,300 times the permitted amount of anhydrous ammonia (yes, one thousand three hundred times).  

That is 1300x the amount that needs to be reported to the Federal government, not what is permissible. Just a distinction. They could have that much, but they would have been regulated more by the Feds had they reported it. It had already been reported to the state. They don't have a good record with reports, though.

I saw that he didn't get the win.  In a game where the team has the lead in the fifth and keeps it, is it always the pitcher finishing the fifth who gets the win?  I thought the official scorer had some discretion in those games.  Clemens line didn't look deserving when compared to Bedard's.  

The starter has to go at least 5 innings to be eligible for the win. After that, the scorer does have some discretion.

I got the tickets in the mail today. 20 of 'em, View Deck II, Section 430, eleven on Row 10 and nine on Row 11. The best part is that on the back of the ticket is a coupon for 20% off THE ENTIRE GUEST CHECK at Houston area Denny's. Well, except for the 2468 Value Menu, whatever that is.

The bad news is that Mr. Happy can't make it in because the air fare is onerous, so unless something breaks his way we'll have an extra ticket if someone wants it. Or another seat buffer between my funky butt and the rest of you guys.

I'm still collecting tickets if they are available.

Basically, a knuckle curve is thrown with more than one finger tip on the ball, like a kuckleball.  It is much closer to a true knuckleball grip and is thrown with a more fastball-like motion (like the knuckleball), which is more deceptive.  This is what Burt Hooton threw.  What they call a spike curve, is really just digging one fingernail into the ball to get a better grip.  It's thrown like a traditional curveball.  The spike curve is what Cliff Lee and Mike Mussina throw.

Question: what Ryan threw was considered a circle curve, correct? Ball between the thumb and first finger, rolling off the finger?

Opening Day update: The date change has resulted in a rash of ticket sales (so they say).

Field Box and Dugout are sold out.

If we want 3B side (out of the sun), there are Club and Terrace available. 

We can get in the All You Can Eat Sections (252 and 253) right now, but they are going fast.

I don't have 20 responses yet.  New policy: I have to pay the entire balance up front, I can't put down a deposit on Opening Day tickets.

Any preference to where we sit?



No preference. Mrs. ETA said add 2 more tickets for a total of 4 if that would help get to the 20 you need. You know she is good for it.

I have never been a huge fan of the hard metal stuff, but back in 1988, I think, my roommate and some other friends came in to my dorm room while I was studying for my biology quiz that evening at ACU. They needed a ride to the Reunion Center for a Savatage/Megadeth/Dio concert that night.

So...I find a scalper and get a ticket. Crazy concert. Savatage booed off the stage, Megadeth was one of the most entertaining bands I have ever seen, and the main show, Dio, was a big letdown. Drove back to Abilene in a sleet storm after the concert and decided that 4 am is a good time to make the 8 hour drive back to Lake Jackson...since I was up and didn't think they would miss me in my Friday classes.

It will always stick out to me how good Megadeth was without the whole light show/main billing. Just straight talent.

Just saw some pics on facebook from friends at the game.  Lots of empty seats for an 8-1 team.

I don't live near Houston, but is there really such tepid interest in this team?  I know the Jaguars are not a marquee opponent, but still. You only get to see the home team a relatively small number of times in the NFL.

My real concern was that the Jets' shitty offense was teaching the rest of the country how to counter the Texans' blitz.  It took Wade a Kubiak* to adjust to the Jets running draws and screens.  When he did, they shut 'em down again.


I think losing Cushing for most of the game had an effect on their defense. He is solid at picking up on the plays, giving the line more opportunity to focus on the pass rush and blitz. It may take some time to adjust to not having one of the most solid LBs holding the line.

Where I work, there will be dropped phones. After all the abuse, I take my phone out of the case once a week to clean the case. The phone looks brand new after almost a year. My son's iPhone has been broken twice in the past year from drops about hip high.

Here, an Android fanboy does drop tests for the iPhone 5 and Samsung Galaxy S3.

The iPhone got a little scuffed up on the edges after 4 consecutive drops onto stone from pocket, chest, ear and head height.  The Samsung screen cracked from the chest-high drop, and again from the ear-high drop, which also saw the back come flying off (but that was ok because it's just a cheap bit of plastic...WTF?).  He didn't even try the head-high drop on the Samsung.

On durability, it was game, set, match iPhone.

My Samsung, in the otterbox, seems indestructible.

However, to call the yard during a game and talk to or get a message to the usher to find out who's sitting in your seats who you aren't struck me as somewhat odd.

I actually had some fantastic tickets to a game in another MLB stadium. Someone "borrowed" the tickets from my friend the day before we were to go. We still went to the game and sat in some of the worst seats I have ever sat in in my life, but we did call to have the original seats watched. Someone was fired over the situation the next day.

There may be more to the story than simply having someone watching the game on TV.

And look for me in the good seats tonight. Happy 22nd anniversary to my wonderful Mrs. ETA, and thank you gleach.

I'm not really allowed to tell you who I represent unless a client tells me I can.  I might not go as far as denying that I represent a client, but in a weird way that would be ethically less troubling than telling you I did represent someone without their consent.  Court dates are not confidential and should be posted in the county court system, but the lawyer has no obligation to tell you the date.

If he was out on parole, it's probably a different set of rules than a simple arrest.  If he's an adult, his lawyer's  probably ethically unable to tell you confidential information.  The son could direct him to, but then the information might not be confidential. 

That is what I think, except: Can a lawyer deny he is representing someone, or even given advice to someone? Is a court date confidential?

Sorry. I didn't mean to sound like I had a problem with either one. My wife has power of attorney for him so she can handle paperwork and finances. I know that doesn't mean his representing attorney has to talk to her, but he has before. This time, they just say they know nothing about the case. I suspect it means that, though he is set to represent him, they have not been issued paperwork by the court as there has been no court date set. I'm not even sure that they have to set a court date anytime soon since he was put back in jail due to parole violation.

There is really nothing we can do, but it would be nice to know a little more than we do now. If they have decided to let him fulfill his sentence in jail rather than on parole, it would help us (and our son obviously) to plan for that.

I'm sorry, this is way outside my legal knowledge.  I had a personal problem with a family member, and it took about 24 hours to get the guy processed and out of jail.  You have a choice of posting bond personally (putting cash through a window) or using a bail bondsman.  The bail bondsmen will know all that stuff and that may make it worthwhile, but so will a criminal attorney, and we found the county sheriff's office to be very helpful. 

What county are you in?

He is in Montogery County. It is a little more complicated than that.  I didn't want to waste everyone's time on here about it.

Short story: He was out on parole and he broke the rules. They arrested him and put him back in jail. He's been there a few weeks and they still haven't set a court date. We have the name of his lawyer, but the lawyer doesn't realize he is the lawyer, or he just won't discuss the case with us. All the information we have is coming from our son in prison, and he doesn't seem to know what is going on.

I was just hoping someone here might have some criminal law background and could tell us if this is normal.

What I'm getting at is that paying the penalty is dead money, while paying the premium gets you broader insurance than you have now.

The issue many people, including those in professional risk management jobs, is that most of the time an insurance premium gets you a bunch of gobbledegook on too much paper and nothing else.  If you don't have a claim, you would have been better off not buying it.  Very true.  Yet people still buy (sometimes involuntarily, like collision liability), because what they have done is transferred their risk of loss to an insurance company.

That's the true value of an insurance policy.

It is dead money, but I don't have a choice. It is a tax that I have to pay unless I purchase something I don't want to pay for.

I know these numbers are wrong, but I am guestimating the best I can:

$500/month to cover the family = $6000/yr
-or-
$1000 tax
$50/mo for catastrophic = $600/year
~$2500 for doctor care without insurance (on the high side for my family, but not unreasonable)
= $4100


So, $6000 (admittedly for fairly good coverage) vs. $4100 with the risk of a major injury or illness covered

...and, maybe, my catastrophic will be enough to negate the tax.

I can take the extra money and keep it in my health care fund for next year.

I do agree, though. It seems the ACA went to far and not far enough at the same time. I/m worried that trying to balance it between free market and socialism may actually make it worse and more expensive with all the regulation and paperwork.

Actually, I'd argue the opposite.  The cost to the government in lost revenue - as people to sick to work stop paying taxes and force relatives to stop working (and paying taxes) to care for them - would be catastrophic.

And as a conservative/libertarian type person, I believe this is why the ACA is terrible.

Social Security being "bankrupt" is a misnomer and pure fear-mongering.  The date people often describe as the date it becomes "bankrupt" is actually the date that SS is projected to take in 1c less than it pays out.  That's not bankrupt by any definition, simply the date that incremental additional revenue will be required to fund the system.  Of course, any changes to the benefit structure in the meantime will move that date, and it's so subjective to legislation that it's impossible to rely on any projection from year to year.

Shit, a bad flu season will move the date.

I said nothing about that.  don't want to count on someone else having to pay for my retirement. If I get the SS I paid for, it is a nice bonus. If not, I will still be fine or still working. Just curious, how should public transportation be funded?  You can't ride it until it is built.
I don't know. How? Riders? Communities? Cities? States? Regions? What does the federal government have to do with riding between UH and downtown Houston?

They help handle national emergencies. That seems to be part of the federal government's job. That is different, to me, to saying I have to pay someone to handle my healthcare.

I've been chastised here before for my healthcare choices, but I stand by them. I have catastrophic coverage for my family and pay my doctors out of pocket for routine care (which is WAY cheaper than insurance). Now, I get to pay more so the government can be involved, or pay an insurance company more than what my health care needs are, and those costs will probably go up due to paperwork and regulation.

I'm not sure how that service is covered in protecting our borders, interstate commerce, infrastructure, or our judicial system without a major change to our constitution. It seems to be constitutional, but it doesn't mean I have to like it.

Overall, unpopular. Certain provisions are popular, though, such as carrying coverage from one employer to another, carrying kids until they are 26+ ( I forget the age cutoff), and not denying for preexisting ailments. The unpopular issues are fines for not carrying insurance and medicare mandates to the states.

There is a law that says you cannot challenge taxes until after you have paid them (it's so the government can have some near-term assurance of revenue without having everything tied up in court forever). One argument was that this appeal was invalid because no one has paid the penalty/tax on the mandate yet. Court ruled that for the purposes of that act, the mandate was a penalty and not a tax. It's a bit of a threading the needle, because he upheld the constitutionality of the mandate because it was a tax, not a penalty, but when you read the opinion/reasoning it makes sense and there seems to be a fairly direct precedent.

I have seen people say - after the mandate was upheld as a tax - that not doing so would open the door for people to challenge taxes in general.  I'm no lawyer, and I didn't stay at a Holiday Inn last night, so I have no idea.

I agree that the politics of this thing has steamrollered most debate about the actual constitutionality of the elements of the bill.  I think most pudnits, and many politicians, are gobsmacked that the Supreme Court appeared to do exactly that.  You know...their job.

I am at a loss to find what I had read recently, and of course I am no lawyer, but there was something about not being able to sue the federal government over taxes? Maybe  read it wrong. The only way this is constitutional is by calling it a tax, if I understood the discussion by real lawyers. BO insisted it wasn't a tax, but it wouldn't be legal otherwise.

The girl in the article raised her GPA over a full point to 3.54 in the semester she was with us.  Her admitting university said that was the reason she was admitted despite a lackluster academic history before that.  

The other had to choose between Johns Hopkins medical, the Air Force Academy (with two congressional nominations!), Univ. of Maryland Biology and was courted by Harvard (but declined), this after being out of school for over a year prior to the two years she has been with us.  I won't say which she chose but regarding both girls, it was not overbearing parental micro-management that made this happen, rather, it was simply providing a safe, nurturing, loving place for them to heal and allow their existant strengths to flourish.

I say this because 1) I am proud of them but mostly 2) so that anyone that reads this will know that the abilities and talents that most of us have as parents can be used for to make a real difference in someone(s) life.  So, I'll leave you all with a question:

If not you, then who?

That AB by Altuve shows me that he is not quite there yet. He swung at some pitches that he couldn't hit and took a pitch that he could. He can get even better than he is at  the plate.

You're right. I don't understand how he gets so much speed on the pitch because he short-arms it. He must be very strong.

After my shoulder was ripped apart, I short armed my throws for better speed than I have ever had before. IMO, it leads to ruining your arm very quickly. Not a good form.

I've read a ton of science fiction. Whatever makes a book well written is the same as any other genre: a good story, good characters, well written. Only the setting changes. The best science fiction, to me, seems to play a minor role in the story. You want the character development and interaction. For example, take Firefly, as something many people here enjoyed. The stress was the characters, not the science fiction.

Ray Bradbury did that brilliantly. The sci-fi was an added element, but it set up the characters in a unique situation to develop the stories.

I haven't read it since I was a kid, but I actually enjoyed L Ron Hubbard's Battlefield Earth. Reading it again may prove less satisfactory. The movie was terrible. Like any genre, there will be good and bad.

Callis butchered that, based on my understanding. The Pirates have 2.9 mil for their first pick.  They can't transfer all that other money from their 6.5 mil total to use towards Appel.  Either Appel signs for something under 3.5ish or the Pirates better take a bunch of low-rent chumps with their next picks.

It's a story almost ripped from the headlines coming out of the Nuba Mountains. The movie was made many years ago by the Cheyene Production company (Willis production company) as their first venture.

Wow. On my list. I watch very few movies, but this seems a worthy story.

I missed Tears of the Sun.

Act of Valor was very good,if anyone has missed it. Sure, alot of the acting is done by non-actors (real navy seals), but you quickly forget that.

I spent Memorial Day in a way I hadn't planned. My neighbor, a single lady trying to sell her house, was out of town. Wehn I went for my walk in the morning, I found water bubbling up out from under her garage. She was in San Antonio. I got to help replacing her water main. My wife got cooking duty (which was probably better than me drinking beer and tending the grill). Still, the neighborhood took time to stop and have a moment.

Just so we're clear, don't think Tebow is great as much as he's inspiring to watch. In a "little engine that could" sorta way. He's not supposed to win in the NFL with his skill set, so we've been told over and over again. And the playoff game with the Patriots sorta exposed that. So time will tell if Tebow becomes yet another Heisman ex who did some good things here and there and even had his "moments", but to say he's top ten in the list with Earl? No way.

I agree on Bo Jackson, but it was indeed too short to quantify. Tim Brown?  Okay, I'll agree. Hershel Walker is missing from your list and had it not been for the USFL, he would have been one of the better Heisman NFLers around, IMHO.

Sorry, didn't make it through the whole list. Walker was very good. I just think any of those guys would be ahead of Tebow on a top 10 list.

Earl was my first football "hero", so I'm trying to not be too "homer" about where he should go. I really do like Tebow. He is a good kid with a ton of determination that never says stop. He does it in a competitive, but gentlemanly? way. That is rare. He has won with that attitude, both on the field and with fans and teammates. I'll even root for him sometimes. I don't think he is a great player.

I dunno, those guys were "good" NFL players but not necessarily great. Of course, neither is Tebow or even Cam at this point of their careers as well. Funny you have Flutie on this list. Tebow and Flutie compare well in terms of skill sets... lots of desire and determination, limited pure NFL quarterback skills.

I do agree there are different requirements for college vs. NFL, btw. Two exceptions: Tim Brown was very good. Bo Jackson was great, but too short a career.

The Heisman Throphy jinx in the NFL is pretty much a given. Most of the guys who are considered the best college player of the year usually flame out in the NFL because what you're asked to do in college and what you're asked to in the NFL are very different.  Andre Ware will tell you so. So why would Tebow be on this list?  I dunno, but he hasn't  exactly flamed out either. Is he a better NFL player than 'Erl? No way. What I am surprised at is how they were able to find 10 good NFL Heisman winners to begin with.

Eddie George
Ricky Williams
Vinny Testaverde
Doug Flutie

All have done much more, even if they had problems. That is just a few.
